The Constitution of Bangladeshi American Cultural Association (BACA)
Introduction:
Just as the constitution is essential in the management of the state, same way constitution is very important for the management of the organization.The constitution is a reminder of an organization.To direct the organization,every leader and member of the organization have to follow the constitution.
1. The name of the organization :- Bangladeshi American cultural association(BACA)
2. Area of organization :- The whole new York area will be considered the area of organization.
3. Goals and objectives of the organization :-
a) To carry the education culture and heritage of Bangladesh to our new Bangladeshi generation who ate living outside of Bangladesh.
b) In every way to help and co-operate the people who are in danger and problems.
c) To establish Bengali and music schools to build indigenous culture among the new generation.
d) immigration service for the immigrants and to provide health care once a year.
e) Every year organizing street fair and cultural events to highlight Bangladeshi culture and heritage to the outside of Bangladesh.
f) Publish regular souvenirs for the development of Bengali literature among the new generation.
g) To organize a picnic every year for the entertainment of the Bangladeshi people.
h) To organize Iftar party in the holy month of Ramadan, reunion in Eid and Durga Puja.
i) To celebrate the national days of Bangladesh, such ad national independence day, martyrs day and victory day with due dignity and respect.
j) To provide humanitarian assistance to the people affected by natural calamities including floods and droughts in the country as much as possible.
k) To take necessary steps to encourage the new generation in the field of education and to reward the meritorious students accordingly.
4. Members of the organization :- There will be two types of membership in the organization.
a) general member b) life member.
a) General member : any Bangladeshi above 18 years of age can become a member of organization for one year by filling in the form and depositing 20 dollars in the organization’s fund. however, the general member has to renew the membership by depositing 20 dollars every year.
b) Life member :- living in the united States, any Bangladeshi above 18 years of age can become lifetime member by paying 200 dollars in one time in the organization’s fund. There is no need to renew the membership for lifetime members.
5. Organizing committee :- there will be a committee to manage the organization. The number of members of this committee will be 23.
6. Outline of the committee :- one president, five vice presidents, one general secretary, three joint general secretaries, one treasurer, one organizing secretary, one publicity and public relations secretary, one sports and recreation secretary, one law and international secretary, one school education and social welfare secretary.six executive members.
7. Term of the committee :- The term of the committee will be three years.A new committee will be formed every three years.
8.Committee formation process :- honesty and accountability are essential in the process of formation of the committee. before making a new committee, present committee will make an election commission three months before the election. A chief commissioner and two commissioner will be nominated from the members of the organization for election commission .This commission will make a new committee by arranging vote with secret ballot.The executive committee will prepare and send the voter list to the election commission two months before the election. The election commission will arrange the election according to this voter list. No one will be able to take part in the election or activities unless there is a general or lifetime membership of the organization.
9.Board of trustees :- The board of trustees will be formed to assist the executive committee in conducting the activities of the organization.The number of board of trustees will be 9.The president of the organization shall be a member of this committee by ex officio. The remaining 8 members will be nominated from outside. Everyone of the committee will have the title ” member “. The term of this committee will be 3 years. The executive committee shall nominate the members of the board of trustees within two months of the formation of the executive committee.
The member of board of trustees, must be a member ( general or lifetime ) of the organization. Otherwise he or she lose the qualification to be a board of trustees.
10.Functions of committee officers :-
a) President – The president is the main organizing person of this organization.He or she convened and presided over the meetings of the executive committee, the general meeting and the board of trustees meeting.Moreover, the funds of the organization will be controlled and managed under the signature of the general secretary, treasurer as well as the president.
b) Vice president – In the absence of the president, the vice president shall act as the president. moreover, it is the responsibility and duty of the vice president to assist president in his or her daily activities and to perform any of the duties assigned to him or her by the committee.
c):- General secretary – The general secretary is the chief executive of the organization.One of his or her main functions is to convene and conduct general meetings and executive committee meetings with the permission of the president. Moreover it is the job of the general secretary to maintain the assets of the organization along with valuable files and to prepare and present the report of the general meeting. Moreover, the funds of the association are managed and controlled under the joint signature of the president, the treasurer and the general secretary.
d) Joint general secretary :- In the absence of the general secretary, the joint general secretary shall perform the routine duties of the general secretary.Moreover, to assist the general secretly, the joint secretly shall perform all the duties assigned him or her by the committee.
e) Treasurer – The treasurer is the chief accountant of the organization. All economic transactions of the organization are given through the treasurer.
Besides, it is the job of the treasurer to prepare and present the report of income and expenditure in the general meeting and keep all the accounts of the organization. also president and general secretary will sign with treasurer to take money from the account of the organization.
f) Organizational secretary – The work of the organizational secretary to keep the structure of the organization strong including the recruitment of the members of the organization.The main task of the organizational secretary to approve the member form and explain the money received from the treasurer.
g) literary and cultural secretary – The main job of the literary and cultural secretary is to edit and publish the souvenirs and magazines of the organization and to supervise literary and cultural events of the organization.
h) Publicity and public relationship secretary – The main task of this secretary is to take appropriate initiative in publicizing and disseminating all the activities of the organization. Besides, it is the responsibility of the publicity snd public relationship secretary to take appropriate measures for the publication of the news in the organization and to supervise all types of publications including poster lraflets.
i) Sports and entertainment secretary – It is the duty of the sports amd entertainment secretary to conduct sports competitions in the picnic, to arrange and supervise the Ifter Mahfil, picnic and all other events including purchase of prizes of sports competition.
j) Mass education and social welfare secretary – Supervise all activities related to education and students and take necessary steps for organizing educational programs, arranging Iftar parties in the holy month of Ramadan, cooperating in performing religious ceremonies of other communities including Hindus and it is the duty of the secretary of mass education and social welfare to take necessary steps to provide necessary assistance to the people affected by natural calamities in the country and abroad.
m) Law and international secretary – it is the job of the law and international secretary to supervise the health camps organized by the organization for the welfare of the expatriate community and to ensure the immigration facilities.
n) Members – attending the meetings of the organization, participating in the organizational activities and fulfill the responsibilities given by the organization.

12- Office of the organization : – There will be an office to manage the activities of the organization. Unless a permanent office is built, any residential or commercial building may be used as an office of the organization subject to the approval of the committee.
13 – Meeting of executive committee and board of trustees :- The executive committee will meet once every two months and the board of trustees will meet once a year to manage the activities of the organization. In addition, emergency meetings can be held for special needs.
14 – Functions of the board of trustees :- The main function of the board of trustees is to provide overall support to the executive committee with necessary advice in the overall activities of the organization. anything other than day to day activities of the organization must be done with the approval of the board of trustees.In this case, if necessary, a joint meeting can be held. The position of a member of the board of trustees is basically an honorary position. Therefore, they should be given due respect in all the events of the organization.
15 – Transfer of power :- The outgoing committee shall transfer power to the new committee in the presence of the election committee within a month of the formation of the new committee of the organization.
16 – Notice of exemption, expulsion and show cause :- If any officer or member of the association is found to be involved in any activity in violation of the constitution and against the organization, he or she may be expelled from the organization subject to specific evidence. However, before taking the mentioned disciplinary action, the accused person must be given a chance to defend himself /herself by giving a show cause notice within a minimum of one week.
17 – No-confidence motion : – If any officer or member of the organization engages in arbitrariness or misconduct, in the meeting of the executive committee by the opinion of the majority, he/she can be removed from duty by bringing a motion of no conference against him. However, the removal must be approved by calling a general meeting within a minimum of 15 days. Any no-confidence or removal without the approval of general meeting is deemed void.
Conclusion : – The 17 mentioned points and all the related sub-points will be considered as the constitution of the Bangladrshi American Cultural Association. Only with the approval of the general meeting, the constitution will be effective and necessary additions and deletion will be made.
